Terms & Conditions
Last updated: 10 October 2026
Please see below our website terms & conditions, and the options available to you concerning their use.
These Terms and Conditions (“Terms”) apply to all web design services provided by Stoked Creative (“we”, “us”, “our”) to you (“you”, “the client”), and to your use of https://stokedcreative.com.au. By paying a deposit, completing our onboarding checklist, or otherwise asking us to start work, you agree to these Terms.

Our services
We design and build custom WordPress websites for small businesses. A standard website package includes the items listed on our website at the time you order, currently a custom design of up to four pages, built on WordPress with the Divi theme builder, with an SEO-ready foundation and the latest plugins. Anything not listed in your package is an extra and may cost more.
Pricing and payment
All prices are in Australian dollars (AUD) and include GST. Our website package starts from $1,500, and add-ons are priced as listed on our website, for example extra pages and stock images.
- A deposit of 50% is due before we begin work.
- The remaining balance is due when your website is approved, and before it goes live.
- Invoices are payable within [14] days unless we agree otherwise.
- If an invoice is overdue, we may pause work or delay your launch until it’s paid.
We’ll tell you the price of any extras in writing, and agree it with you, before we start that work.
Domain, hosting and third-party costs
Domain registration, hosting, email and similar services aren’t included in our package price. We can help you set these up through our hosting partner, currently EdHosting, whose fees are set by them and may change. Your agreement for those services is with the provider, not with us. Other costs, such as premium plugins, stock images beyond those in your package, or paid integrations, are also separate and only added with your agreement.
What we need from you
To build your website within our usual timeframe, we need you to:
- complete our onboarding checklist
- give us your content (text, images, logos and branding) or tell us if you want us to create or source it
- give us feedback and approvals promptly
Timeframes
Our standard build takes about 1-2 weeks, starting from the day we receive your deposit, completed onboarding checklist and all the content we need. These are estimates, not guarantees. If you’re slow to send content, feedback or access, your timeline moves back accordingly, and we may reschedule your project to fit other work. We aren’t responsible for delays caused by things outside our control, including third-party providers.
Revisions and approval
Your package includes 2 rounds of adjustments after we send you the first version of your website. A round means one consolidated list of changes, not a series of small requests over several days. Work beyond this, including new pages, a change of design direction or content that arrives after approval, is charged at $100 per hour, or as a fixed quote we agree in advance. When you approve your website, we’ll treat the work as accepted and ready to launch.
Your content and your responsibilities
You’re responsible for the content you give us. By supplying it, you confirm that you own it or have permission to use it (including text, photos, logos and trademarks), and that it doesn’t infringe anyone else’s rights or break the law. You agree to cover us for any claims arising from content you supply. If we source stock images or other material for you, we’ll use properly licensed material, but you shouldn’t reuse it elsewhere unless its licence allows.
Ownership and intellectual property
Once you’ve paid in full, you own the custom design and the content we created specifically for your website. Until full payment, we keep ownership of the work and may withhold launch or hand-over.
Some parts of your website are licensed from third parties and aren’t owned by either of us, including WordPress, the Divi theme builder, plugins, fonts and stock images. They stay under their own licences, which may require renewal or have their own terms. We keep ownership of our general skills, methods, code snippets and tools that we use across projects.
Portfolio and promotion
We’d like to show your finished website in our portfolio and marketing, with a link to your site. If you’d rather we didn’t, tell us in writing and we’ll leave it out.
Search engine optimisation
We build your website with SEO best practice in mind. SEO is influenced by many things outside our control, including search engine algorithms, your competitors, your content and how your website is promoted over time. We don’t guarantee any particular ranking, traffic or number of enquiries.
After launch
For 14 days after launch, we’ll fix any errors caused by our work at no charge. After that, or for anything outside the original build, support is charged at $100 per hour unless we agree otherwise. Once your website is live, you’re responsible for keeping it up to date, including updates to WordPress, themes and plugins, backups, security and hosting renewals, unless you’ve arranged ongoing support with us. We recommend changing any passwords you shared with us once your project is complete.
Cancellation and refunds
You can cancel your project at any time by telling us in writing. If you cancel, you’ll pay for the work done up to that point, and the deposit is non-refundable once work has begun. If we cancel for a reason other than your breach, we’ll refund any payment for work we haven’t completed. We may end the project if you don’t provide what we need, don’t pay on time, or treat us unreasonably.
Limits on our liability
We’ll provide our services with due care and skill. Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or other laws that can’t be excluded. Subject to that, and to the extent the law allows:
- we aren’t liable for indirect or consequential loss, including lost profit, lost sales or loss of data
- we aren’t liable for problems caused by third-party providers, such as hosting outages, plugin failures or cyber attacks on your site after hand-over
- our total liability to you for any claim is limited to the amount you’ve paid us for the services the claim relates to
If we breach a consumer guarantee that can’t be excluded, our liability is limited, where the law allows, to re-supplying the services or paying the cost of having them re-supplied.
Privacy
We handle your personal information as described in our Privacy Policy and our Cookie Policy.
Use of this website
You may use our website for lawful purposes only. Content on this website, including text, design and graphics, belongs to us or our clients and may not be copied or reused without permission. We try to keep the information on our website accurate, but we don’t guarantee it’s always complete or up to date.
Disputes
If there’s a problem, please contact us first so we can try to resolve it directly and quickly. If we can’t reach agreement, we’ll consider mediation before either of us starts legal proceedings.
Governing law
These Terms are governed by the laws of Queensland, Australia, and both of us submit to the non-exclusive jurisdiction of the courts of Queensland.
Changes to these Terms
We may update these Terms from time to time. The “last updated” date at the top shows when they were last revised. The Terms that applied when you ordered continue to apply to your project, unless we both agree otherwise.
