My Terms & Conditions

1. Introduction

These Terms and Conditions govern all custom web design and development services provided by Daniel Pearson trading as Stoked Creative ("I", "me", or "my") to the client ("Client" or "you"). By engaging my services and paying any invoice or deposit, you agree to be bound by these Terms. This Agreement is governed by the laws of Queensland, Australia.

2. Services & The Human Touch

I specialise in high-quality, custom WordPress website design. I believe that effective design requires a human soul and a personal touch to truly connect with your customers. Every website is manually crafted and overseen by me personally to ensure a premium, bespoke result.

All projects include SEO optimisation, SSL integration, and lightning-fast speeds as standard. Each project follows a specific Scope of Work (SOW); any requests outside this scope will be quoted and billed separately by me.

3. Payment Terms

• Deposit: A non-refundable 50% deposit is required before work commences to secure your position in my production schedule.
• Final Balance: The remaining balance is due upon delivery of the first full website draft or as per agreed milestones.
• Handover: Final website files and administrative access will be transferred only once the final invoice has been settled in full.

4. Client Responsibilities & Delivery

My 1-week+ turnaround is a partnership. To maintain this efficiency, you agree to:

• Provide all text, high-resolution logos, and imagery before the project start date.
• Respond to my feedback requests or drafts within 48 hours.
• Ensure all supplied materials comply with Australian Consumer Law (ACL).

I am not responsible for missed deadlines caused by delays in your feedback or the late delivery of assets.

5. Revisions & Scope Control

Your package includes a set number of revision rounds (specified in your quote). A "round" is defined as one consolidated list of feedback provided to me. Reasonable use includes up to 10 specific change requests per round. Major functional changes or entirely new design directions after initial approval are considered out-of-scope and will be billed at my standard hourly rate of $150 + GST.

6. Ownership & Intellectual Property

• Transfer: Full ownership of the website design transfers to you upon my receipt of final payment.
• Portfolio: I retain the right to showcase your completed website in my portfolio and marketing materials.
• Credit: A discreet "Website by Stoked Creative" link may be placed by me in the footer of the site.

7. Technical Liability & Support

Websites are tested on the latest versions of Chrome, Safari, and Firefox. I am not liable for issues caused by third-party hosting, external plugin updates, or platform changes (e.g. WordPress core updates) after handover. I offer a 14-day "bug-fix" period post-launch for any technical errors identified.

8. No Refund Policy

In accordance with Australian Consumer Law, refunds are not available for change of mind or change of creative direction once work has commenced. All sales are final as my service is based on dedicated, bespoke professional labour.

9. Dispute Resolution

In the event of a dispute, we both agree to first attempt a good-faith resolution via discussion or mediation in Cairns, QLD, before pursuing legal action.

10. Acceptance

By paying your deposit or engaging my services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
